1. Introduction & Who You Contract With
Cardemio is operated by KSUR Services ("we", "us", "our"), the legal entity trading as Cardemio. By accessing or using Cardemio you enter into a binding agreement with KSUR Services and agree to these Terms and Conditions. If you do not agree, please do not use the service. You confirm that you are of legal age to enter into this agreement, or that you have authority to bind the organisation you represent.
2. Service Description
Cardemio is an AI-powered flashcard and quiz platform that allows users to upload PDFs, generate study decks, take quizzes, add notes, and share content with the community. Features and availability may change without notice.
3. User Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 13 years old to use Cardemio.
4. Acceptable Use
You must not misuse Cardemio. In particular, you agree not to: use the service for unlawful purposes; commit fraud, send spam, or abuse free usage limits; upload or generate content that infringes intellectual property or privacy rights; upload or generate illegal content, hate speech, harassment, deepfakes, or malware; attempt to jailbreak, bypass, or manipulate our AI safeguards; or interfere with the security or integrity of the service (probing, penetration attempts, automated scraping, or reverse engineering). We may remove or restrict content, filter or refuse AI outputs, and suspend accounts that violate these rules.
5. Intellectual Property & Licence
KSUR Services retains all ownership of the Cardemio service, its software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the service within your selected plan; you may not resell, redistribute, reverse engineer, or circumvent technical limits. You retain ownership of content you upload and, as between you and us, of the study materials generated from it; you grant us a limited licence to host and process that content solely to provide the service, and to display decks you choose to publish publicly. You confirm you have the rights to any document or text you upload. Rights-holders may request a takedown at support@cardemio.com; we remove infringing material and terminate repeat infringers.
6. AI-Generated Content
Cardemio uses AI models to generate flashcards, quizzes, summaries, and explanations. You are responsible for your prompts and uploads, for how you use the outputs, and for verifying their accuracy. AI outputs may be inaccurate, incomplete, or outdated, and must not be relied on as medical, legal, financial, or other regulated professional advice without qualified human review.
7. Service Availability
We work to keep Cardemio available, but we do not guarantee uninterrupted or error-free performance. The service is provided "as is" and, to the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
8. Subscriptions, Billing & Payments
Cardemio offers paid subscription plans (e.g., the Pro plan at $5.99/month). Subscriptions renew automatically at the end of each billing cycle at the then-current price until cancelled. You may cancel at any time through your account or via the customer portal; cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. Fees are stated exclusive of applicable taxes, which may be added at checkout. Prices, plans, and features may change; material changes will be communicated in advance. 9. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's Buyer Terms (https://www.paddle.com/legal/checkout-buyer-terms) govern payment, billing, tax collection, invoicing, cancellations, and refund mechanics for your purchase.
10. Limitation of Liability & Indemnity
To the fullest extent permitted by law, KSUR Services shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months preceding the claim. Nothing excludes liability for fraud, death, or personal injury caused by negligence, or any liability that cannot be excluded by law. You agree to indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
11. Suspension & Termination
We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your access ends; you may export your decks before deleting your account, and remaining personal data is deleted in line with our Privacy Policy.
12. Governing Law & Assignment
These terms are governed by the laws of the Kingdom of Morocco, and disputes shall be resolved in the courts of Casablanca. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control.
13. Changes to Terms
We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms.
